Agreeing to these terms

These Terms of Service ("Terms") are an agreement between you and KaFinca ("KaFinca," "we," "us") for using the KaFinca app at app.kafinca.com, the website at kafinca.com, and any related services (together, "KaFinca"). By creating an account or using KaFinca, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use KaFinca.

Who can use KaFinca

You must be at least 13 years old. If you're under 18, you need permission from a parent or guardian. If you use KaFinca for a business, you're agreeing to these Terms for that business and confirming you're allowed to do that.

Your account

• Give accurate information and keep your sign-in secure. You're responsible for what happens on your account.
• Your @handle is your stable identity. You can change it once every 90 days, and a released handle is held for 90 days before anyone else can take it. Your display name can change anytime.
• We can reclaim a handle that impersonates someone, infringes a trademark, or is offensive.
• Let us know right away at hello@kafinca.com if you think someone else is using your account.

Your content

"Your content" means the logs, ratings, notes, photos, business listings, and feedback you add to KaFinca.

• You own your content.
• You give KaFinca a non-exclusive, worldwide, royalty-free license to store, copy, display, and process your content to run and improve KaFinca. For logs you mark Community, that includes showing them to other members on the map, in the feed, and in search. This license ends when you delete the content or your account, except for copies in routine backups for a limited time.
• We may use information about how KaFinca is used overall, in a form that doesn't identify you, to improve KaFinca and to share summary insights with coffee businesses.
• Only add content you have the right to share. Don't upload other people's photos without permission.
• You can export your journal or delete it anytime in Settings.

Community rules

KaFinca works because people trust what they read. When you use it, please don't:

• Post fake, paid, or misleading reviews, including reviewing your own business or a competitor's.
• Harass, threaten, or bully anyone, including baristas and business owners.
• Post hateful, sexually explicit, or illegal content, or anyone's private information.
• Impersonate a person or business.
• Spam, run scams, or post ads outside the tools we provide.
• Use direct messages to sell to people who did not ask, or to keep writing to somebody who has stopped answering.
• Share what somebody wrote to you privately as though it were public.
• Scrape, copy, or collect data from KaFinca in bulk, or use bots.
• Try to break, overload, or get around KaFinca's security, or access other people's accounts or private data.

We may remove content or limit accounts that break these rules. Honest negative reviews are welcome. A 3 out of 10 you really believe is exactly the kind of thing KaFinca is for.

The Fence, and messaging other members

The Fence is public to members. A question or a note you post there, and any answer you write under somebody else's, can be read by every KaFinca member. Write it as though the whole room can see it, because it can.

Direct messages are private to the two people in them. Nobody else can read them, including us. The exception is a message one of you reports, which we read so we can deal with the report. Private does not mean unaccountable: the rules above apply just as much in a message as on the Fence.

Two tools are yours whenever you want them:

• Report a post, an answer, a message or a member. We are sent a copy of the thing you reported, and we decide whether it comes down.
• Block a member. You stop seeing each other on the Fence, and neither of you can message the other. We do not tell them.

There are limits on how much you can post and message in a day. They exist to stop spam, not to stop a conversation, and you are unlikely to meet one by using KaFinca normally.

We may take down anything that breaks the rules, and we may limit or close an account that keeps breaking them. If something is urgent or somebody is in danger, contact your local emergency services, not us.

For roasters, cafés, and carts

• KaFinca is roaster-neutral. Every coffee business is shown on the same terms. Businesses can't pay to change members' ratings, remove honest reviews, or push competitors down.
• Anyone can suggest a listing. If you claim or verify a listing, you confirm you're authorized to represent that business, and we may ask for proof.
• Keep your listing accurate, including hours, locations, and contact details.
• Paid features for businesses, like founding roaster plans, will come with their own pricing and terms, shown to you before you pay. Those terms are added to these Terms.

Bag scans, freshness, and other tips

Scan the Bag uses AI to read labels, and it can get things wrong, especially roast dates and handwritten labels. Freshness timelines, reorder reminders, and ratings are general guidance and other members' opinions, not guarantees about any coffee. Check the details that matter to you, including allergens, caffeine, and ingredients, with the business directly.

Links and other services

KaFinca may link to roaster websites, shops, and social apps, and lets you sign in with Google or Apple. Those services have their own terms and privacy policies, and we aren't responsible for them or for anything you buy from a business you find through KaFinca.

KaFinca's stuff

The KaFinca name, logo, design, and software belong to KaFinca. You can use KaFinca as intended, but you can't copy, resell, or build a competing service from it. If you send us ideas or feedback, we can use them without owing you anything.

Ending your use

You can stop using KaFinca and delete your account anytime in Settings. We may suspend or end accounts that break these Terms, put others at risk, or create legal trouble for KaFinca. We'll try to give notice when it's reasonable to do so. We may also change or discontinue features, and if we ever shut KaFinca down, we'll give you a chance to export your journal first.

Disclaimers

KaFinca is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, including that KaFinca will be uninterrupted, error-free, or that information on it is accurate. Keep your own copy of anything you can't afford to lose; the Export button is there for that.

Limits on liability

To the fullest extent the law allows, KaFinca won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Our total liability for any claim relating to KaFinca is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you.

Your responsibility

If you break these Terms or the law, or your content causes a claim against KaFinca, you agree to cover the reasonable costs, including legal fees, that result.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Contra Costa County, California, unless the law where you live gives you the right to bring it elsewhere. Before filing anything, please email us so we can try to work it out.

Changes to these Terms

We may update these Terms as KaFinca grows. If a change is meaningful, we'll update the date at the top and let members know in the app or by email before it takes effect. Continuing to use KaFinca after that means you accept the updated Terms.

Everything else

If part of these Terms can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given up the right to. You can't transfer these Terms to someone else, but we can as part of a sale or reorganization of KaFinca. These Terms and the Privacy Policy are the whole agreement between us about KaFinca.
